Disclaimer for Remote Session

BY ACCEPTING A REMOTE CONNECTION TO YOUR COMPUTER FROM A TRAXERO NORTH AMERICA SUPPORT AGENT (“SUPPORT AGENT”), YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE WITH THE FOLLOWING TERMS. PLEASE DO NOT PROCEED ANY FURTHER OR ALLOW A SUPPORT AGENT REMOTE ACCESS TO YOUR COMPUTER IF YOU DO NOT AGREE WITH THE FOLLOWING TERMS.

 

You have requested assistance from TRAXERO North America (“we”, “us”, or “our”), through an assigned Support Agent, to provide you with technical support through a remote connection to your computer (a “Remote Session”). You understand and agree that in order for us to fulfill your request for such assistance, you will need to provide a Support Agent with access to and control of your computer as reasonably required to perform the requested work.

 

By accepting a Remote Session from us, you accept full responsibility for any changes to the contents or system settings of your computer. You also indicate that you have read, understand, and agree with the following terms before continuing:

 

  • Be sure to close any confidential files that are open on your computer.  We take no responsibility for any inadvertent viewing of confidential content or information in files or computer programs that are left open during the Remote Session.  PLEASE BE AWARE THAT THE SUPPORT AGENT MAY HAVE A LEGAL OBLIGATION IN CERTAIN JURISDICTIONS TO REPORT ANY INFORMATION OF WHICH THEY MAY BECOME AWARE THAT WOULD INDICATE ACTUAL OR SUSPECTED ABUSE OR MISTREATMENT OF CHILDREN OR OTHER GROUPS OF PROTECTED INDIVIDUALS.
  • TRAXERO North America recommends that you remain by your desktop throughout the entire Remote Session to facilitate the completion of the assistance that you have requested.
  • To avoid any loss of data or inconvenience to you, please ensure that you possess a full backup of all data on your computer systems and/or network file server prior to this service.
  • The Remote Session requires the transmission of information across an internet connection.  You acknowledge that, while the ConnectWise ScreenConnect software implements technology features designed to protect the security of this transmission, there is no guarantee of security or privacy on the internet, and we offer no guarantee and provide no warranty (express or implied) that the Remote Session will be secure or private.
  • Your failure to comply with all reasonable directions of the Support Agent is likely to prevent the Support Agent from providing the requested remote assistance.
  • The Remote Session may be cut short, delayed, rescheduled and/or terminated as a result of matters outside of our reasonable control.

 

Although the Support Agent will use commercially reasonable efforts to perform the requested work, we cannot warranty or guarantee that the Support Agent will be able to successfully resolve all issues.  We do not warrant that the technical support will meet your needs or requirements, is fit for your purposes, or will be error free. The Remote Session is provided at your sole risk and we will not be liable to you for any loss, costs, expenses or damages incurred by you, including but not limited to any direct, indirect, incidental, consequential, or special damages. 

 

If for any reason, the disclaimer in the preceding paragraph is deemed to be unenforceable by a court of applicable jurisdiction, then to the maximum extent permitted by law, our liability to you (including any liability of any Support Agent) shall be limited to direct damages not to exceed the total amount paid to us for this Remote Session, or, if no amount has been paid, to $10.00.
